1.2 Where to Send Your Notice

2. Our Response to a Valid Notice
Upon receipt of a valid DMCA takedown notice, Docsicar will:
- Review the notice to confirm it meets all legal requirements
- Remove or disable access to the allegedly infringing content promptly
- Notify the party who posted the content, if applicable, that the material has been removed
- Document the notice for our records in accordance with DMCA requirements
Incomplete or invalid notices may not be acted upon. We reserve the right to request additional information to verify a claim before taking action.
3. Counter-Notice Procedure
If you believe that content was removed from our website as a result of a mistake or misidentification, you may submit a written counter-notice. To be valid, your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your full name, mailing address, telephone number, and email address
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Docsicar may be found
- A statement that you will accept service of process from the person who submitted the original DMCA notice, or their agent
Send your counter-notice to the same designated agent contact listed in Section 1.2 above, using the subject line
"DMCA Counter-Notice."
Upon receipt of a valid counter-notice, we may restore the removed content within 10 to 14 business days unless the original complainant notifies us that they have filed a court action to restrain the activity.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Docsicar has adopted a policy of terminating, in appropriate circumstances, the accounts or access of users who are deemed to be repeat infringers of copyright. We reserve the right to make this determination at our sole discretion.
5. Important Notes
Physical used books: Docsicar sells physical, pre-owned repair manual books. We do not host, distribute, or reproduce the copyrighted content within those books in digital form. The sale of a lawfully obtained used physical book is protected under the
First Sale Doctrine (17 U.S.C. § 109), which permits the resale of legally purchased copyrighted works.
Misrepresentation: Please be aware that under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
